although people within are equal in rights and duties in
spite of the fact that it provides a significant space regarding
personal freedom and is not contradictory to democracy, es-
pecially in regard of choosing the ruler, but it constitutes
election regulations based on the new term of consultation.
The consultative Islam was dedicated through the Verse
No. (38) in Surat Ash-Shura:
"And those who have responded to their lord and estab-
lished prayer and whose affair is [determined by] consulta-
tion among themselves, and from what we have provided
them, they spend".

Some explainers considered that "consultation"is re-
stricted to the consultative group who are the makers of
opinion, science, and virtue who govern the muslims; Allah
is the ultimate guardian of servants, guider of their affairs
and determiner of their fate.
This ultimate divine authority on people is transferred
to the Prophet so he becomes the one who guarantees its
implementation and seeks its fulfillment on muslims and he
stays responsible for this authority, conducts it, and ensures
its right fulfillment. He is concerned over the believers and
